    Christmas Gift Promotion - Terms & Conditions

    1.         STANDARD TERMS
     
    1.1     By entering the Christmas Gift promotion (Promotion), entrants acknowledge that they have read these terms and conditions and agree to be bound by them. Information on how to enter forms part of the terms and conditions.
     
    1.2     The Promotion is being run by Australia Pacific Airports (Melbourne) Pty Ltd ABN 076 999 114 999 114 (Promoter) of Level 2, Terminal 2, Tullamarine, Victoria 3043 in conjunction with WH Smith Australia Pty Ltd (WH Smith) of suite 306, Axis Corporate Centre, 46-50 Kent Road, Mascot, New South Wales 2020.
     
    1.3     The Promotion commences at 9.00am AEDT on Monday, 4 December 2017 and concludes at 5.00pm AEDT on Wednesday, 20 December 2017 or until stocks last, whichever occurs first (Promotion Period).
     
    1. The following retailers in Terminal 4 are participating – WH Smith, Victoria’s Secret, Witchery, Trenery, Country Road, Mimco, Amuse, Sunglass Hut, Muffin Break, McDonald’s, Think Asia, Salsa’s, Ali Baba, Oporto, Chop Salads, Sixpence Pies, Brasserie Bread, icons, Two Johns, Brunetti, Rip Curl, Mac, Quick Shots, Quick Fix, Velocity Café, Sushi Sushi, Boost Juice, Tech2go, Krispy Kreme and Go Convenience (Participating Retailers).
     
    2.         WHO CAN ENTER?
     
    2.1     Entry is open to people of any age.
     
    2.2     Entry is limited to one entry per person per day during the Promotion Period to a maximum of three entries during the Promotion Period.
     
    2.3     Officers, employees and immediate families of the Promoter and Participating Retailers are limited to one entry during the Promotion Period.
     
    3.         HOW TO ENTER
     
     3.1                To enter the Promotion, spend $50 or more at Participating Retailers during the Promotion Period and present the valid receipt(s) to staff at WHSmith, Terminal 4.  Multiple receipts may be aggregated to reach the minimum spend.  Once a receipt has been presented, it will be stamped and cannot be used for future entries.
     
    3.2     Each entrant will receive 1 book from either the Penguin Classics (2500 units), Mr Men (2500 units) or WH Smith Fresh Talent (1500 units) ranges (Gift), until the allocation is exhausted.  There are a total of 6500 Gifts available for the Promotion.
     
    3.3     The Promoter and WHSmith reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process.
     
    3.4     Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
     
    4.         GENERAL
         
    4.1     Gifts may not be exactly as illustrated in displays or marketing for the Promotion.
     
     
     
    4.2     If a Gift is unavailable, the Promoter, in its discretion, reserves the right to substitute the Gift with a gift to the equal value and/or specification.
     
    4.3     The Promoter assumes no responsibility for lost, misplaced, destroyed or stolen Gifts once they are claimed and these Gifts are not redeemable for cash and cannot be transferred or exchanged.
     
    4.4     The Promoter’s decision is final and no other correspondence will be entered into.
     
    4.5     In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to government legislation.
     
    4.6     Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the Promoter's liability in relation to the consumer guarantees under the Australian Consumer Law (Non-Excludable Guarantees Liability).
     
    4.7     Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees Liability, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Promotion including (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control) (b) any theft, unauthorised access or third party interference (c) any entry that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter (d) any variation in Gift value to that stated in these terms and conditions (e) any tax liability incurred by the entrant or (f) the use of the Gift.
     
    4.8       If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
     
    4.9     In participating in the Promotion, entrants agree to participate and co-operate as required in all editorial activities relating to the Promotion, including but not limited to being interviewed, filmed for broadcast and photographed. Entrants agree to grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner (and his/her companion) will not be entitled to any fee for such use.
     
    4.10   Please read the Promoter's privacy policy available on the Promoter website at http://melbourneairport.com.au/privacy-policy.html which explains how personal information may be collected and used.
     
    4.11   The Promoter may, for an indefinite period, unless otherwise advised, collect personal information through the Promotion and use and disclose the information to conduct the Promotion and for Promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant and any other purpose set out in the Promoter's Privacy Policy. Entrants should direct any request to opt out, access, update or correct information to the Promoter. Personal information (if any) collected through the competition includes first name, last name, contact phone number, email address, postcode and date of birth. The Promoter may disclose personal information to subsidiary and related companies, third parties or regulatory bodies, including but not limited to agents, contractors and service providers for the purposes set out in this clause.
     
    4.12   The laws of Victoria apply to this Promotion.  Entrants submit to the exclusive jurisdiction of the laws of Victoria.
