Melbourne Airport Parking & Mastercard – 61st Annual GRAMMYAwards® Experience
By entering the Melbourne Airport Parking & Mastercard – 61st Annual GRAMMYAwards® Experience (‘competition’), you acknowledge that you have read these terms and conditions and that you agree to be bound by them. Information on how to enter forms part of these terms and conditions. Entry into the competition is deemed acceptance of these terms and conditions.
This competition is being run by Australia Pacific Airports (Melbourne) Pty Ltd ABN 62 076 999 114 of Level 2, Terminal 2, Melbourne Airport, Tullamarine, Victoria, 3043 (‘Promoter’). To contact the Promoter, please call (03) 9297 1523.
1. WHO CAN ENTER
a. To be eligible to enter the competition you must: i. reside in Victoria; and ii. be aged 18 years or over.
b. Employees, directors or officers of the Promoter, any companies or agencies (or employees, directors or officers of companies or agencies) associated with this competition, or immediate family members of any of the above, are ineligible to enter. Immediate family means any of the following: spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
2. HOW TO ENTER
a. The competition period commences at 4pm AEDT on 21/12/2018 and ends at 11:59pm AEDT on 24/1/2019 (‘competition period’). The Promoter reserves the right to extend the competition period at any time (subject to regulatory approval, if required).
b. To enter the competition, entrants must, during the competition period, book Melbourne Airport Parking online at www.melbourneairport.com.au/grammyawards, pay using their Mastercard, park at Melbourne Airport before 31/10/2019 AEST and use the promo code GRAMMY2019.
c. The promo code GRAMMY2019 will only be valid for bookings made during the competition period for car park entries and exits between 4pm AEDT on 21/12/2018 and 11:59pm AEST 31/10/2019. Bookings for parking outside this period will be invalid.
d. If an entrant books and pays with a credit card other than Mastercard the entry will be invalid.
e. No late entries will be accepted. Incomplete, incoherent or inappropriate entries will be invalid.
f. There are no limits to the number of entries per person if the above criteria has been satisfied. There can however, only be one valid entry per booking.
g. All bookings are subject to Melbourne Airport’s standard terms and conditions of parking, available at www.melbourneairport.com.au/parking.
h. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s age, identity, place of residence, employer and transaction value) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process or engages in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
a. Total prize value is $26,700 as at the publishing date of these terms and conditions.
b. Prize package must be used 8-11 (USA dates) February 2019 (save for Prepaid Mastercard – see below) and is inclusive of the following (itinerary to be determined by the Promoter in its absolute discretion):
• Round trip economy flights for two (2) from Melbourne (Tullamarine Airport) to Los Angeles (LAX)
• 4 day/3 night twin-share, minimum 4-star hotel accommodation in Los Angeles, inclusive of airport transfers and daily breakfast.
• Private city tour of Los Angeles for the winner and their guest on Day 2, 9 February 2018.
• Professional makeover prior to the GRAMMY Awards® for both winner and their guest
• Welcome Dinner Reception for the winner and their guest
• Exclusive Mastercard pre-reception for the winner and their guest
• Two (2) Gold tickets to the GRAMMY Awards® on 10 February
• Two (2) tickets to the Mastercard After-Party following the GRAMMY Awards®
• One (1) 300 USD Prepaid Mastercard. The prepaid card is accepted worldwide and must be used within 12 months.
c. Subject to 3b above, all out-of-pocket expenses, spending money, meals, travel expenses, travel insurance and any other ancillary costs and expenses incurred by the winner and their nominated guest (excluding airline and airport taxes) that are related to the prize are the responsibility of the winner.
c. The winner may be required to present their credit card at time of accommodation check-in.
d. The prize is not transferable for a date other than the package date specified.
d. The prize is transferable but not convertible to cash and not for resale.
e. If the winner wishes to assign the prize to another person, the winner must submit a statutory declaration within 24 hours to Michelle Goulos of Melbourne Airport Parking indicating the complete name of the person to whom the prize will be transferred, from whom the same documentary requirements must be required. The assignee must be a Victorian resident and be aged 18 years or over and must be an existing Mastercard cardholder. Any assignee will be bound by these terms and conditions as though references to the winner were references to the assignee (where relevant). Acceptance of the prize by an assignee will be deemed acceptance of these terms and conditions.
f. If a prize (or part of a prize) is not available for any reason, the Promoter reserves the right to substitute the prize with another item of equal or greater value if the winner agrees in writing and subject to any required approvals from regulatory authorities. If the winner does not agree despite reasonable attempts by the Promoter to reach an agreement and the prize is not available due to circumstances beyond the Promoter's control, the Promoter may substitute the prize with another item or items determined by the Promoter to be of equal or higher value.
g. To claim the prize, the winner must contact Michelle Goulos from Melbourne Airport Parking on [email protected]
or (03) 9297 1068 with the following information for the winner and accompanying guest within 24 hours of being notified of winning:
• Details of valid Passports
• Details of valid Visas
h. It is the winner’s responsibility to have a valid visa for entry into the US for both themselves and their guest prior to departure. In the event that the winner or their guest are subsequently denied entry into the US the prize will be forfeited and the Promoter shall have no liability to the winner or their guest.
i. The winner and their guest must make themselves available for the scheduled flights to and from Melbourne Airport with the airline arranged by the Promoter. The Promoter shall bear no liability in the event that the winner and/or their guest miss the scheduled flights, in which case the prize will be forfeited.
j. The prize is subject to any terms and conditions of individual prize and service providers. Winners acknowledge that individual prize and service providers reserve the right to eject any winner (and/or their guest) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize. The Promoter shall have no liability to the winner or their guest in the event that this occurs and the relevant aspect of the prize will be forfeited.
4. SELECTION OF WINNER
a. The winner will be chosen at random by Melbourne Airport’s appointed agency, McCann Worldgroup Pty Ltd. The draw will take place at their Sydney premises at Royal Naval House, 32 Grosvenor Street, Sydney NSW 2000 at 5:00pm AEDT on 25 January 2019.
b. The first valid entry drawn will win the prize as described above.
c. The winner will be personally notified by Facebook comment and/or message within 2 business days of the draw and the name of the winner will be published on the Melbourne Airport Facebook page once the winner is confirmed.
d. The results of the draw will be final and binding and no correspondence will be entered into in relation to the results of the draw. This is a game of chance.
e. The Winner must arrange to pick up any tickets and any accompanying itinerary information from Melbourne Airport Management, Level 2, Terminal 2, Melbourne Airport, 3045, Victoria prior to travel and as advised by the Promoter.
5. SECOND CHANCE DRAW
a. If the winner does not respond within 24 hours of being notified that they have won the competition, or if the winner is not readily identified and reasonable efforts made by the Promoter to identify the winner were unsuccessful, they will automatically forfeit their prize and the Promoter reserves the right to select another winner through a second chance draw.
b. If necessary, a second chance draw will be held on 28/1/2019 at the same time and place as the first draw, subject to any written directions from a regulatory authority. The first valid entry drawn will win any unclaimed prize.
c. The winner will be personally notified by Facebook comment and/or message within 24 hours of the draw and the name of the winner will be published on the Melbourne Airport Facebook page within 48 hours.
d. The results of any second chance draw will be final and binding and no correspondence will be entered into in relation to the results of the draw.
e. The Promoter will distribute the prize to the winner prior to the travel day.
6. PROMOTION AND MARKETING
a. By entering the competition, the winner consents to participate in such promotional activity and editorial activities relating to the competition, including but not limited to being interviewed, filmed for broadcast and photographed, as the Promoter, Mastercard and/or The Recording Academy may require, without remuneration. The winner and their guest agree to grant the Promoter, Mastercard and The Recording Academy a perpetual and non-exclusive licence to use any such footage, recordings, materials and photographs in all media worldwide for the purpose of promoting the competition and/or the businesses of the aforementioned parties and the winner (and their guest) will not be entitled to any fee for such use.
b. The winner and their guest also consent to the use and publication of their name, image, likeness and any other details provided by the winner in any marketing material of the Promoter, Mastercard and/or The Recording Academy without any further reference or payment to the winner or their guest.
7. STANDARD TERMS
a. The Promoter reserves the right to amend the competition and its terms and conditions at any time and for any reason, subject to regulatory approval if required, and will notify entrants of any such amendments as soon as reasonably practicable via the Melbourne Airport Facebook page. b. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify, the Promoter's liability in relation to the consumer guarantees under the Australian Consumer Law (‘Non-Excludable Guarantees Liability’).
c. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees Liability, the Promoter, Mastercard and The Recording Academy jointly and severally (including their respective officers, employees and agents) exclude all liability (including negligence) for any personal injury, or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the competition including: i. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); ii. any theft, unauthorised access or third party interference; iii. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter, Mastercard or The Recording Academy; iv. any variation in prize value to that stated in these terms and conditions; v. any tax liability incurred by the winner or entrant; or vi. use of the prize.
d. To the extent permitted by law, including the Australian Consumer Law, if the competition is not capable of running as planned including by reason of technical failure, fraud or any cause beyond the Promoter's control, the Promoter may cancel or suspend the competition or invalidate any affected entries, subject to regulatory approval if required.
g. By participating in this competition, entrants release and hold harmless Facebook from any and all liability associated with this competition. The Promoter and entrants acknowledge that this competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants acknowledge that they are providing information to the Promoter and not to Facebook.
h. The Promoter is not liable for any tax implications arising from prize winnings, including fringe benefits tax. Independent financial advice should be sought.
i. The laws of Victoria apply to this competition. Entrants submit to the exclusive jurisdiction of the laws of Victoria.
