Melbourne Airport Parking & Mastercard – AO 2019 VIP Superbox Experience
By entering the Melbourne Airport Parking & Mastercard – AO VIP Superbox Experience (‘competition’), you acknowledge that you have read these terms and conditions and that you agree to be bound by them. Information on how to enter forms part of these terms and conditions. Entry into the competition is deemed acceptance of these terms and conditions.
This competition is being run by Australia Pacific Airports (Melbourne) Pty Ltd ABN 62 076 999 114 of Level 2, Terminal 2, Melbourne Airport, Tullamarine, Victoria, 3043 (‘Promoter’). To contact the Promoter, please call (03) 9297 1523.
1. WHO CAN ENTER
a. To be eligible to enter the competition you must: i. reside in Victoria; and ii. be aged 18 years or over.
b. Employees, directors or officers of the Promoter, any companies or agencies (or employees, directors or officers of companies or agencies) associated with this competition, or immediate family members of any of the above, are ineligible to enter. Immediate family means any of the following: spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
2. HOW TO ENTER
a. The competition period commences at 10:00am AEST on 03/12/2018 and ends at 11:59pm AEST on 19/12/2018 (‘competition period’). The Promoter reserves the right to extend the competition period at any time (subject to regulatory approval, if required).
b. To enter the competition, entrants must, during the competition period, book Melbourne Airport Parking online at www.melbourneairport.com.au/ao2019, pay using their Mastercard, park at Melbourne Airport before 31/10/2019 and use the promo code TENNIS2019.
c. The promo code TENNIS2019 will only be valid for bookings made during the competition period for car park entries and exits between 10:00am AEST on 3/12/2018 and 11:59pm AEST 31/10/2019. Bookings for parking outside this period will be invalid.
d. If an entrant books and pays with a credit card other than Mastercard the entry will be invalid.
e. No late entries will be accepted. Incomplete, incoherent or inappropriate entries will be invalid.
f. There are no limits to the number of entries per person if the above criteria has been satisfied. There can however, only be one valid entry per booking.
g. All bookings are subject to Melbourne Airport’s standard terms and conditions of parking, available at www.melbourneairport.com.au/parking.
h. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s age, identity, place of residence, employer and transaction value) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process or engages in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
a. Each winning entry will receive 1 x double pass to AO2019 Superbox VIP Experience (including food and beverage package) for the AM session of the quarter finals on Wednesday 23 January 2019. There are a total of 8 x double tickets to be won. Total prize value is $23,000 as at the publishing date of these terms and conditions.
b. The prize does not include any costs associated with redeeming the prize such as travel, meals (other than what is provided in the Superbox), accommodation, spending money or taxes.
c. The prize will not be transferable to another person or for a date other than the AM session of the quarter finals on Wednesday 23 January 2019.
d. No part of a prize is exchangeable or redeemable for cash or any other prize.
e. If a prize (or part of a prize) is not available for any reason, the Promoter reserves the right to substitute the prize with another item of equal or greater value if the winner agrees in writing and subject to any required approvals from regulatory authorities. If the winner does not agree despite reasonable attempts by the Promoter to reach an agreement and the prize is not available due to circumstances beyond the Promoter's control, the Promoter may substitute the prize with another item or items determined by the Promoter to be of equal or higher value.
f. The prize is subject to any terms and conditions of the VIP Superbox venue. Winners acknowledge that the event organiser reserves the right to eject any winner (and/or any companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
4. SELECTION OF WINNER
a. Winners will be chosen at random by Melbourne Airport’s appointed agency, McCann Worldgroup Pty Ltd. The draw will take place at their Sydney premises at Royal Naval House, 32 Grosvenor Street, Sydney NSW 2000 at 5:00pm AEST on 7/1/2019.
b. The first 8 valid entries drawn will win the prize as described above.
c. The winners will be personally notified by Facebook comment and/or message within 2 business days of the draw and the names of the winners will be published on the Melbourne Airport Facebook page once winners are confirmed.
d. The results of the draw will be final and binding and no correspondence will be entered into in relation to the results of the draw. This is a game of chance.
e. The Promoter will distribute the prize to the winners by email prior to the event day.
5. SECOND CHANCE DRAW
a. If a winner does not respond within 24 hours of being notified that they have won the competition, or if a winner is not readily identified and reasonable efforts made by the Promoter to identify the winner were unsuccessful, they will automatically forfeit their prize and the Promoter reserves the right to select another winner through a second chance draw.
b. If necessary, a second chance draw will be held on 11/1/2019 at the same time and place as the first draw, subject to any written directions from a regulatory authority. The first valid entry or entries drawn will win any unclaimed prize(s).
c. The winner(s) will be personally notified by Facebook comment and/or message within 2 business days of the draw and the name of the winner(s) will be published on the Melbourne Airport Facebook page within 48 hours.
d. The results of any second chance draw will be final and binding and no correspondence will be entered into in relation to the results of the draw.
e. The Promoter will distribute the prize to the winner prior to the event day.
6. PROMOTION AND MARKETING
a. By entering the competition, each winner consents to participate in such promotional activity and editorial activities relating to the competition, including but not limited to being interviewed, filmed for broadcast and photographed, as the Promoter, Mastercard and/or Tennis Australia may require, without remuneration. Each winner agrees to grant the Promoter, Mastercard and Tennis Australia a perpetual and non-exclusive licence to use any such footage, recordings, materials and photographs in all media worldwide for the purpose of promoting the competition and/or the businesses of the aforementioned parties and the winners (and their companion) will not be entitled to any fee for such use.
b. Each winner also consents to the use and publication of their name, image, likeness and any other details provided by the winner in any marketing material of the Promoter, Mastercard and/or Tennis Australia without any further reference or payment to the winner or their companion.
7. STANDARD TERMS
a. The Promoter reserves the right to amend the competition and its terms and conditions at any time and for any reason, subject to regulatory approval if required, and will notify entrants of any such amendments as soon as reasonably practicable via the Melbourne Airport Facebook page. b. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify, the Promoter's liability in relation to the consumer guarantees under the Australian Consumer Law (‘Non-Excludable Guarantees Liability’).
c. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees Liability, the Promoter and/or Mastercard jointly or severally (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury, or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the competition including: i. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); ii. any theft, unauthorised access or third party interference; iii. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or Mastercard; iv. any variation in prize value to that stated in these terms and conditions; v. any tax liability incurred by the winner or entrant; or vi. use of the prize.
d. To the extent permitted by law, including the Australian Consumer Law, if the competition is not capable of running as planned including by reason of technical failure, fraud or any cause beyond the Promoter's control, the Promoter may cancel or suspend the competition or invalidate any affected entries, subject to regulatory approval if required.
g. By participating in this competition, entrants release and hold harmless Facebook from any and all liability associated with this competition. The Promoter and entrants acknowledge that this competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants acknowledge that they are providing information to the Promoter and not to Facebook.
h. The Promoter is not liable for any tax implications arising from prize winnings, including fringe benefits tax. Independent financial advice should be sought.
i. The laws of Victoria apply to this competition. Entrants submit to the exclusive jurisdiction of the laws of Victoria.
