Terms and Conditions

Welcome to the Melbourne Airport app (“App”), which is provided by Australia Pacific Airports (Melbourne) Pty Ltd (ACN 076 999 114) (“Melbourne Airport”, “we”, or “us”). The App is Melbourne Airport’s information hub, providing details on flight information, parking and transport options and retail offerings.

1. These terms and conditions of use (“Terms”) apply to your use and access of the App at any time, so it’s important that you read and understand them.
2. The Terms and our privacy policy (available at melbourneairport.com.au/privacy-policy) (“Privacy Policy”) form a binding agreement between Melbourne Airport and you.
3. We may update these Terms from time to time without notifying you. If we make material changes, we will notify you through the App. Your continued use of the App after any changes constitutes acceptance of the updated Terms.
4. If you do not agree to these Terms, you must not access or use the App. For the purposes of these Terms, any reference to 'you' or 'your' includes but is not limited to the owner and authorised user of the device used to access the App.
5. You must be over 16 years of age to use the App. If you are under 16 years old, you must have permission from your parent or legal guardian to access and use the App, and they must accept these Terms on your behalf. 
6. The App is provided on an 'as is' basis. Melbourne Airport does not provide any warranty or guarantee:
   • as to the accessibility, security, stability or reliability of the App and Melbourne Airport specifically disclaims any liability or responsibility for any App faults, failures or interruptions or the accuracy, timeliness, completeness, security or reliability of any communications (including, without limitation, any transactions) made using the App; and
   • that information included in the App is complete, accurate or up to date at any time and you acknowledge that such content and information is subject to change without notice.
7. These Terms and any pages accessed via the App may contain material which is subject to intellectual property rights, including copyright. You acknowledge and agree that Melbourne Airport either owns or licenses all such intellectual property rights and that nothing in these Terms constitutes a transfer of any intellectual property rights to you. To the extent necessary, Melbourne Airport grants you a non-exclusive, non-transferable and revocable license to access and use the App and any related intellectual property rights, subject to these Terms.
8. To the maximum extent permitted by law, Melbourne Airport excludes all liability for any loss or damages arising from reliance on the App. Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law or other legislation that cannot be excluded by agreement.
9. You agree to indemnify Melbourne Airport and its personnel, employees, agents and representatives, from and against all loss, damage, liability, charge, expense or cost (including all reasonable legal and other professional costs on a full indemnity basis) caused or contributed by your unlawful use of the App, breach of these Terms, any applicable law or third party rights, unless the loss, damage, liability, cost or expense was caused or contributed to by Melbourne Airport’s negligence, wilful misconduct, fraud, breach of these Terms or any applicable law.
10. The App may contain links to other websites and/or services, apps or resources that are also operated by Melbourne Airport (“Other Services”) and third-party services. Your use of each of these Other Services may be subject to additional terms and conditions that supplement these Terms, and third-party services are governed by separate terms and conditions.
11. Melbourne Airport has no control nor do we endorse or accept responsibility for any third-party services or sites that are not operated by us or for the third-party content, products, or services accessible through the App. Your use of third-party services or sites is entirely at your own risk, and we accept no responsibility for any loss that may arise from your use of them.
12. Melbourne Airport reserves the right to immediately suspend, terminate or limit your access to the App if:
    • you are in breach of these Terms;
    • you attempt to manipulate or bypass any limitations of the App by any means;
    • you behave in a vexatious, illegal, inappropriate, or unsociable manner (whether in Melbourne Airport itself or as a user of the App);
    • we believe on reasonable grounds that there is a real risk of serious loss or damage to Melbourne Airport or a third party if we do not suspend, terminate or limit your access; or
    • an emergency or other circumstance warrants suspension, termination or limitation of your access to the App.
13. These Terms are governed by the laws of Victoria, Australia. Any dispute arising under these Terms is subject to the non-exclusive jurisdiction of the courts of Victoria.
14. If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision is deemed severed and, where capable, the validity and enforceability of these Terms is not affected.
15. You may not assign or transfer any of your rights or obligations under these Terms.  We may assign or transfer our rights or obligations under these Terms at any time without restriction and without providing your notice or obtaining your consent.  In such circumstances, we may transfer or assign your personal information as provided by you to us, subject to the terms of our Privacy Policy.
16. These Terms are the entire agreement between you and us regarding its subject matter.
17. The App is controlled and offered by us from Victoria, Australia.  We make no representation that the App is appropriate or available for use in other locations.  Those who access or use the App from other jurisdictions do so at their own risk.
