Premium Valet Terms and Conditions

These terms and conditions set out the basis upon which the motor vehicle owner or operator (you or your) agrees to accept the Premium Valet services (Valet Services) provided by Australia Pacific Airports (Melbourne) Pty Ltd ABN 62 076 999 114 (APAM, we or our) and any of its contractors (Contractors) (the Terms).

In addition to the below Terms, you agree to our Melbourne Airport Parking Terms and Conditions (which are displayed at the entrance to all of our car parks) and if applicable our Melbourne Airport Car Parks – Online Booking Terms and Conditions.

  1. By presenting your motor vehicle (Vehicle) to APAM or its Contractors, you represent and warrant that you are the registered owner or authorised controller of the Vehicle and agree to be bound by these Terms for the duration of time the Vehicle is within the custody, retention or control of APAM and its Contractors.
  2. You must comply with all rules and directions issued to you by APAM or its Contractors.
  3. Before the Vehicle is left within the custody, retention or control of APAM and its Contractors, you agree to:
    • ensure that the Vehicle is secure, roadworthy and has a valid registration for the period the Vehicle is subject to the Valet Services; and
    • leave the physical car key or electronic remote control, if the Vehicle is controlled by a remote keyless system, in the possession of APAM or its Contractors.
  4. APAM will use due care and skill in providing you with the Valet Services. You acknowledge and agree that use of Valet Services includes the inherent risks, including (but not limited to):
    • damage being caused to persons, vehicles or other property by third party drivers, pedestrians and other persons;
    • hazards created by weather and environmental conditions;
    • theft or malicious damage; and
    • malfunctioning equipment such as lighting, lifts, boom gates, electric vehicle chargers or ticket and payment systems,

(together, the Risks).

  1. You acknowledge that APAM excludes liability under any statutory right or any condition or warranty implied by the Competition and Consumer Act 2010 (Cth) (or similar state legislation applicable from time to time), to the extent permitted by law, limits remedies available to the re-supply of the Valet Services or the payment of the cost of re-supplying the Valet Services.
  2. Subject to your rights under the Australian Consumer Law (ACL) which cannot be excluded, APAM and its Contractors are not liable to you (or any passengers in the Vehicle, or any other party) for any loss, damage, injury, or any incidental, indirect, special, consequential or economic loss or damage (including loss of opportunity, exemplary or punitive damages) whether to person or property (including the Vehicle) and whether arising from default, negligence, misconduct or otherwise by APAM, its employees, Contractors and contractors.
  3. Whilst acting within these Terms, APAM and its Contractors will not be liable for:
    • any damage to or loss of the Vehicle;
    • for any damage to or loss of the Vehicle’s accessories or contents; or
    • any other loss or damage suffered by you or arising from the Risks,

regardless of how the loss or damage is caused, except for any loss or damage that is caused by the fraud, negligence or default of APAM or its Contractors.

  1. Notwithstanding any demand or request to the contrary, APAM or its Contractors may move and drive the Vehicle to such places as APAM or its Contractors deem fit during any period of custody, retention or control of the Vehicle by APAM or its Contractors. This may include locations off-airport, and which may not be under cover. You acknowledge and agree that the Vehicle may be driven on public roads and may be exposed to weather and elements. Subject to your rights under the ACL, you agree that we have no liability for any loss or damage caused by entering and moving the Vehicle for these purposes.
  2. APAM or its Contractors may deliver the Vehicle to any person producing the receipt coupon (Receipt Coupon) or offering such other evidence of ownership or authority or entitlement to receive the Vehicle as APAM or its Contractors deem satisfactory.  APAM or its Contractors may retain the Vehicle until the Receipt Coupon is produced or until they are satisfied in accordance with this Clause 9.  
  3. Provided APAM or its Contractors have satisfied themselves in accordance with Clause 9, APAM or its Contractors will not be liable for:
    • any damage to or loss of the Vehicle; or
    • any damage or loss to any of the Vehicle’s accessories or contents,

caused or contributed to by delivering the Vehicle to a person or entity not authorised to take delivery.

  1. APAM and its Contractors shall have a general lien upon and / or the right of retention over the Vehicle or any of its accessories or contents until all amounts due for the Valet Services or ancillary services rendered by APAM and its Contractors have been paid.  Parking fees continue to accrue during the period APAM and its Contractors retain the Vehicle until all amounts due are paid.
  2. Parking fees will be payable in respect of any period of retention and APAM reserves the right not to deliver the Vehicle in accordance with Clause 9 above until such fees are paid in full.
  3. A credit card service fee will be added to all credit card transactions at the following rates: Visa/Mastercard 1%, Diners 2.28%, Amex 2.41%.
  4. APAM’s Contractors do not have authority to vary these Terms, and no representation by any Contractor may be deemed for any purpose whatsoever to vary these Terms in any way.
  5. By using the Valet Services, you warrant and agree with APAM and its Contractors that as the registered owner or authorised controller of the Vehicle, you shall be liable for and indemnify APAM and its Contractors in respect of any legal liability, loss, claim or proceeding whatsoever arising out of statute or common law in connection with the Valet Services, including:
    • any damage to, or loss of, the Vehicle, its accessories or contents;
    • personal injury to, or death of, any person whomsoever; or
    • any injury or damage whatsoever to any real or personal property which arises whilst the Vehicle is in the custody, retention or control of APAM and its Contractors,

except to the extent that the injury or damage is due to the fraud or negligence of APAM and its Contractors.

  1. No extension of time to use the Valet Services granted by APAM or its Contractors shall adversely affect the rights of APAM or its Contractors under these Terms or at common law.
  2. APAM and its Contractors, in their absolute discretion, reserve the right to retain the Vehicle if the person collecting the Vehicle in accordance with Clause 9 appears to be under the influence of alcohol or any other substance.
  3. APAM and its Contractors, in their absolute discretion, reserve the right to reject the provision of Valet Services, and any Vehicle associated with the provision of the Valet Services, where the Vehicle:
    • is not registered in a State or Territory of Australia at the time the Vehicle is provided to APAM or its Contractors;
    • is registered in a State or Territory of Australia at the time the Vehicle is provided to APAM or its Contractors, but the registration will expire while the Vehicle is in the custody, retention or control of APAM or its Contractors; or
    • is too large, too wide, too long, too high, or otherwise unsuitable to be parked safely within a single marked Valet parking space, or where parking the Vehicle may pose a risk of damage to property, infrastructure, pedestrians, or other vehicles, including, but is not limited to, a Vehicle that overhangs into adjacent bays, obstructs traffic aisles, blocks or impedes pedestrian access paths or designated walkways, exceeds height clearances, or otherwise requires more than one parking space.
  4. If APAM or its Contractors elects to accept a Vehicle for Valet Services that APAM or its Contractors deems at their discretion must be parked across more than one parking bay due to its size or configuration, APAM or its Contractors may, in their absolute discretion, charge additional parking fees corresponding to the number of parking bays utilised to provide the Valet Service to that Vehicle.
  5. Where APAM or its Contractors deem a Vehicle unsuitable for Valet Services, or if you refuse to pay the additional parking fees that may be required in accordance with Clause 19, you will be responsible for making alternative parking arrangements, and APAM and its Contractors provide no guarantee of other parking availability.
  6. By seeking the Valet Services, you and your Vehicle are subject to the Airports Act 1996 (Cth), the Airports (Control of On-Airport Activities) Regulations 1997 (Cth) and the Airports (Control of On-Airport Activities) Regulations 2026 (Cth) (Regulations). Unless APAM receives prior written notice setting out the Vehicle registration number, the reason for the delay and the date collection is anticipated, any Vehicle remaining in APAM or its Contractor’s valet custody, retention or control for more than 30 days after the original agreed date for collection may be moved or disposed of in accordance with the Regulations.
  7. We collect your personal information to provide you with Valet Services and other ancillary services. We may disclose your personal information to our contractors in connection with providing the Valet Services and ancillary services. If you do not provide the information, we may not be able to offer you the Valet Services or ancillary services. We deal with your personal information in accordance with the Privacy Act 1988 (Cth) and our privacy policy at https://www.melbourneairport.com.au/privacy-policy which may be updated from time to time and includes our Privacy Officer's contact details and steps for you to access and correct your personal information, raise a privacy concern with us or opt-out of marketing communications from us.
